Green, and recorded in the Clerk's Office of the Circuit Court of the City of Martinsville, Virginia, and more particularly described below, the obligations secured by said Deed of Trust being in default, the undersigned Substitute Trustee, having been directed to do so by the Noteholder, will offer for sale for cash or other immediately available funds at public auction to the highest bidder, ON WEDNESDAY, AUGUST 21, 2019, AT 11:00 A.M., AT PIEDMONT ARTS ASSOCIATION, 215 STARLING AVENUE, MARTINSVILLE, VIRGINIA, 24112, the following described property and all appurtenances thereto: PARCEL 1: Tax Map #40(02)G/62, PIN 000819300 Credit Line Deed of Trust dated October 27, 2005 and recorded as Instrument Number 0501806. All that certain lot or parcel of land with all improvements thereon and appurtenances thereunto appertaining, presently known as 204 Holt Street, Martinsville, Virginia, situated on the North side of Holt Street and being known as Lot No. 2 as shown on Map of the William R. Stultz property made by Thomas S. Moore, C.L.S., March 30, 1939 and recorded in the Henry County Circuit Court Clerk's Office in Map Book 2, Page 201 and "fronting forty feet on the North side of Holt Street and running back between parallel lines in a Northerly direction to a depth of one hundred and four feet, to Lot No. 33 in the rear, and being forty feet wide in the rear"; and being the same property the grantor herein acquired by deed from Glennie M. Green by deed dated November 28, 2005 from Charlie M. Hightower, doing business as CMB Investment Company, of record in the aforesaid Clerk's Office as Instrument Number LR0502053, to which deed and map reference is here had for a more particular description of the property hereby conveyed. All that certain lot or parcel of land with all improvements thereon located and appurtenances thereon located presently known as 910 Gates Street, Martinsville, Virginia, situated on the South side of Gates Street in the City of Martinsville, Virginia, being known and designated as Lot 22, Section 3 of the Park View Land Company Subdivision, as shown on Plat of Survey for Helena A. Bryant, prepared by J. A. Gustin and Associates, C.E. & L.S., dated March 7, 1977, recorded in the City of Martinsville Circuit Court Clerk's Office in Map Book 13, Page 149; and being the same property the grantor herein acquired by deed from Carmen Johnson, widow, dated August 5, 2009 recorded as Instrument No. LR0900903 in the aforesaid Clerk's Office, to which deed and map reference is here had for a more particular description of the property hereby conveyed. PARCEL 8: Tax Map #39(09)00/78, PIN 000783800 Credit Line Deed of Trust dated December 6, 2005 and recorded as Instrument Number 0502054. All those certain lots or parcels of land with all improvements thereon located and appurtenances thereon located, presently known as 806 Second Street, Martinsville, Virginia, lying and being located in the City of Martinsville, Virginia, each of said lots fronting 30 feet on the West side of Second Street, and running back between parallel lines to a distance of 180 feet, each being 30 feet in the rear, said lots being shown as Lots No. 634 and 635 as shown on Map of The Part of The West View Land Company Subdivision Owned by The Baldwin Investment Company, Incorporated, recorded in the City of Martinsville Circuit Court Clerk's Office in Map Book 1, Page 149; and being the same property conveyed to Wanda M. Green by Deed from Mary B. Law, by Natalie Denise Law, her attorney-in-fact, dated October 25, 2007, recorded in the aforesaid Clerk's Office as Instrument Number LR0701715, to which deed and map reference is here had for a more particular description of the property hereby conveyed. Trustee reserves the right to offer said properties separately or in one or more groups in order to maximize the aggregate recovery. Said property is to be sold in its then current condition "as is" and by special warranty deed. The property will be conveyed subject to all easements, covenants and restrictions of record prior to the Credit Line Deeds of Trust described above. A deposit in the form of certified funds may be required of any bidder at the time of sale. Closing is to be held within ten business days of the date of auction. Time is of the essence. If closing is not held in a timely fashion the deposit is to be forfeited and applied to costs of sale, including the trustee's commission.
