Henry County District Court Judge Jimmy McGarry ruled Thursday that Patrick Leopolo Dziewiecki will continue to be held in the county jail without bond on a rape charge.

Dziewiecki, 59, of 4215 Martin Lane, Axton, was arrested July 1 on charges that he raped a woman in June.

An arrest warrant alleges that Dziewiecki committed rape on or about June 5 or June 6 by having sexual intercourse with the alleged victim “when such act was accomplished through the use of the victim’s mental incapacity or physical helplessness.”

A criminal complaint alleges that on June 20, Investigator P.C. Stone of the Henry County Sheriff’s Office responded to a residence on Orchid Lane where the alleged victim advised that on June 5 or June 6 she was at home “consuming alcoholic beverages and became intoxicated.”

She stated that she did not remember most of the evening hours. She stated that at some point during the night, Dziewiecki came to her residence.

“She stated she did not know exactly what happened after Dziewiecki arrived, [She] stated that when she woke up on 6/6/19, she did not have any pants on,” Stone wrote in his report. “She asked Dziewiecki, who was still at her residence, what had happened. Dziewiecki advised [her] that they had had intercourse. Dziewiecki, stated that [she] had rolled over in her sleep, ‘Which meant that she wanted it.’”

A hearing was scheduled for 3:30 p.m. on Aug. 15.
